Still, there are a few persistent myths about what law clerks actually do - especially in the real estate world. So let’s clear a few things up.


❌Myth # 1: Law clerks can represent clients on their own


Reality: We work alongside lawyers - not instead of them.


Law clerks in Ontario are not licensed to offer legal advice or represent clients independently. Our role is to support the legal process by managing the documentation, tracking deadlines, coordinating with lenders and agents, and flagging issues that need attention. We’re not the lawyer, but we’re often the first to catch what might slow things down.


❌ Myth # 2: Law clerks are just glorified admins


Reality: There’s a lot more to it than emails and filing.


Real estate law clerks are responsible for title searches, reviewing and preparing key documents, organizing closings, working with financial institutions, and making sure all the moving parts come together on time. The work is legal, technical, and time-sensitive. It’s not about taking notes - it’s about getting things done right.


❌ Myth # 3: Law clerks just follow instructions


Reality: A good clerk knows what to look for, and when to speak up.


Yes, we work in support of lawyers, but that doesn’t mean we’re on autopilot. Experienced clerks flag missing information, identify red flags in title or agreements, and often coordinate the logistics that make or break a deal. It’s a proactive role, not just a reactive one.
